The New Jersey Department of Environmental Protection (``DEP") has promulgated cleanup standards and procedures for remediating contaminated sites. The regulations are located at N.J.A.C. 7:26E.

 

Underground Storage Tank Regulations

Homeowners Guide for Cleaning Up Heating Oil Discharges

Many homes are heated with oil that is stored in an underground storage tanks. While homeowners are generally not required to register these tanks, they are responsible for remediating oil leaking from these tanks. This link provides information on the cleanup requirements for home heating oil tanks and the financial assistance program that may be available to homeowners to help pay for the cleanup of heating oil contamination.

 

Industrial Site Recovery Act Regulations

The Industrial Site Recovery Act (``ISRA") requires owners or operators of industrial establishments to demonstrate that the facilities are free of contamination or agree to remediate the contamination before the facilities may be sold, transferred or closed. Regulations implementing ISRA may be retrieved with this link.

DEP Financial Assistance Programs

The DEP has established a variety of loans and grants that may be used by certain owners and operators of contaminated properties to help defray the remediation costs of those sites. This link provides explanations of the qualifying criteria for the various financial assistance programs.

 

Environmental Claims Administration

The DEP has established a fund to help compensate innocent individuals, businesses and local governments who have been damaged by discharges of hazardous substances. This link provides information on the scope of the program and a downloadable form that may be used to file claims against the fund.
