The Environmental Appeals Board (EAB) reviews appeals of administrative
decisions made by EPA. The EAB has authority to hear appeals for
permit decisions and civil penalties assessed by EPA. Appeals of
permit decisions made by EPA's Regional Administrators (and in some
cases, state officials) may be filed either by permittees or other
interested persons. A grant of review of a permit decision is at
the EAB's discretion. Permit appeals are governed primarily by procedural
regulations at 40 C.F.R. Part 124. Appeals of civil penalty decisions
made by EPA's administrative law judges may be filed, as a matter
of right, either by private parties or by EPA. Penalty appeals are
governed primarily by procedural regulations at 40 C.F.R. Part 22.

The U.S. Environmental
Protection Agency's Office of Administrative Law Judges (OALJ) is
an independent office within EPA. The Administrative Law Judges
(ALJs) conduct hearings and render decisions in proceedings
between the EPA and persons, businesses, government entities, and
other organizations which are or are alleged to be regulated under
environmental laws. ALJs preside over enforcement and permit proceedings
as well as proceedings involving alleged violations of environmental
statutes. Most enforcement actions initiated by the EPA are for
the assessment of civil penalties. ALJs are also available to mediate
or assist parties in resolving Superfund (CERCLA) disputes. All
decisions issued by the Administrative Law Judges are subject to
review by the Environmental Appeals
Board (EAB).
The Administrative
Law Judge's initial decision, which is a disposition of all of the
issues in a proceeding, becomes the final order of the EPA within
45 days after service upon the parties unless a party appeals to
the EAB or the EAB on its own initiative elects to review the initial
